Are you already a US Citizen?

First, we determine if you are already a U.S. citizen through birth in the United States, or because your parents were citizens at the time of your birth or naturalized in the United States when you were a child. 

The laws regarding derivative citizenship are extremely complicated.  We have had clients who did not know they were citizens when they were, and others who always believed themselves to be citizens but then didn’t know how to get the documentation to prove it.

US Citizenship Eligibility

If you are not yet a citizen, you may be eligible to apply for naturalization if you:

  • are at least 18 years old at the time of filing

  • have been a legal resident of the US for the past:

    • 3 years, if you’re married to a US citizen

    • 5 years, if you’re applying otherwise

  • have continuous residence in the US

  • can read, write, and speak basic English 

  • demonstrate good moral character

  • demonstrate a knowledge and understanding of US history and government

  • demonstrate a loyalty to the principles of the US Constitution

  • are willing to take an Oath of Allegiance

Some long-time residents over the age of 50 may not be required to read, write, and speak English. In addition specific, more favorable, rules apply to immigrants serving in the U.S. military.
